Origin Car Key Specialists provides automotive locksmith services, vehicle keys, remote controls, proximity/smart keys, transponders, key shells, batteries and related products.
This policy explains our approach to refunds, returns, warranty claims and product or service issues. Nothing in this policy is intended to exclude, restrict or modify any rights or remedies that cannot lawfully be excluded under the Australian Consumer Law.
1. AUSTRALIAN CONSUMER LAW
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law where those guarantees apply.
Depending on the circumstances, if goods or services fail to meet an applicable consumer guarantee, you may be entitled to a repair, replacement, refund, re-supply of services or another remedy provided by law.
This policy operates in addition to those rights.
2. CHANGE OF MIND
We are not required to provide a refund, replacement or credit simply because you:
- change your mind; - no longer require the key, remote, part or service; - sell or dispose of the vehicle; - find the product or service cheaper elsewhere; - order or request the incorrect product or service after providing us with incorrect information; or - decide you would prefer a different style, appearance or type of key after the agreed product has been supplied.
Any change-of-mind return or refund accepted by us is at our discretion and does not affect your rights under the Australian Consumer Law.
3. CUSTOM-CUT AND PROGRAMMED KEYS
Automotive keys, transponder keys, remote keys and proximity/smart keys are commonly cut, coded or programmed specifically to an individual vehicle.
Once a key has been cut, programmed, coded, configured or otherwise customised for your vehicle, it generally cannot be resold or supplied to another customer.
Accordingly, we do not ordinarily accept change-of-mind returns or cancellations for customised keys once cutting, programming or configuration has commenced.
This does not affect any rights you may have where the product or service fails to meet an applicable consumer guarantee.
4. BROKEN, BENT OR PHYSICALLY DAMAGED KEYS
Keys and remotes must be used with reasonable care and only for their intended purpose.
Damage caused after supply by misuse, excessive force, impact, crushing, twisting, bending, dropping, modification or other external causes is not considered a product defect merely because the key subsequently stops working or breaks.
Examples may include:
- a key blade being bent or twisted; - a key being forced into an incorrect, damaged or seized lock or ignition; - using a key as a lever, tool or pry device; - excessive force being applied when turning a key; - a key or remote being dropped, crushed or driven over; - damage caused by carrying the key in a manner that subjects it to excessive bending or pressure; - opening, modifying or attempting to repair the key or remote; - damage caused by another locksmith, repairer or third party; - water, liquid, chemical, heat or fire damage; - damage caused by pets or children; or - any other accidental or abnormal use.
Where inspection indicates that failure resulted from physical damage, misuse, accident, abnormal use or another cause unrelated to the quality of the goods or services originally supplied, Origin Car Key Specialists is not required to provide a remedy for that damage unless otherwise required by law.
5. KEY BLADES, IGNITIONS AND VEHICLE LOCKS
A key blade may be damaged or broken because of a problem elsewhere in the vehicle, including a worn, damaged, stiff, seized or contaminated ignition barrel, door lock or other mechanical component.
Supplying a new key does not constitute a warranty that the vehicle’s existing locks, ignition barrel or related components are free from defects.
If a key is difficult to turn, becomes stiff, bends, twists or requires excessive force, you should stop using it and contact us.
Continued use of a key in a faulty or excessively stiff lock or ignition may cause damage to the key and/or vehicle. Damage caused by an unrelated vehicle fault or by continuing to use the key after a problem becomes apparent may not be covered by us.
6. REMOTE CONTROLS, SMART KEYS AND PROXIMITY KEYS
Electronic keys and remotes contain sensitive electronic components and must be handled appropriately.
Unless the product has specifically been represented as suitable for such exposure, damage caused by water, moisture, washing machines, swimming, impact, crushing, excessive heat, chemicals, unauthorised opening, modification or other external damage is not covered as a product defect.
Normal cosmetic wear from everyday use, including scratches, worn buttons, fading or casing wear, is also not by itself evidence of a defect.
7. BATTERIES AND OTHER CONSUMABLE ITEMS
Batteries and certain other components are consumable items with a service life that varies depending on use, storage conditions, vehicle type, key type and other factors.
Normal battery depletion through use is not considered a defect.
A battery requiring replacement after ordinary use does not, by itself, mean that the remote, key or service supplied is faulty.
Where a battery or other consumable item is defective rather than simply depleted through normal use, your rights under the Australian Consumer Law may still apply.
8. CUSTOMER-SUPPLIED KEYS, REMOTES AND PARTS
Where a customer asks us to cut, program, code, repair or otherwise work with a key, remote, transponder, electronic component or other part supplied by the customer or another third party, we cannot guarantee the quality, compatibility, condition, authenticity or reliability of that item.
We are not responsible for pre-existing defects or failures inherent in customer-supplied or third-party products.
The customer accepts the risk that a customer-supplied product may be incompatible, defective, previously locked, incorrectly specified or otherwise unsuitable for the intended vehicle.
This does not exclude responsibility for loss or damage caused by a failure by us to provide our services with the level of care and skill required by law.
9. VEHICLE FAULTS AND PRE-EXISTING CONDITIONS
Modern vehicle key and immobiliser systems rely on numerous components within the vehicle.
A key-related problem may be caused by components or conditions unrelated to the key or programming service supplied by us, including:
- vehicle battery condition; - ignition or lock faults; - immobiliser faults; - body control modules; - keyless-entry or proximity antennas; - receivers; - wiring or electrical faults; - aftermarket equipment; - previous repairs or programming; - damaged or modified control modules; - software or communication faults; or - other vehicle-related issues.
Our supply or programming of a key does not constitute a guarantee of the condition or future reliability of unrelated vehicle systems or components.
Where a subsequent fault is found to be unrelated to the goods or services we supplied, additional diagnosis, attendance or repair may be chargeable.
10. PROGRAMMING AND ELECTRONIC SERVICES
Automotive key programming involves communicating with the vehicle’s existing electronic and immobiliser systems.
We will perform our services with due care and skill as required by applicable law.
However, we cannot guarantee that unrelated vehicle modules, wiring, batteries, aftermarket systems or previously damaged or modified electronic components will remain fault-free merely because key programming has been performed.
A fault that occurs after our service is not automatically evidence that our work caused the fault.
Any warranty or consumer guarantee claim will be assessed based on the circumstances and, where appropriate, inspection and diagnosis.
11. LOST, STOLEN OR DAMAGED KEYS AFTER SUPPLY
Once a working key or remote has been supplied to and accepted by the customer, we are not responsible for subsequent loss, theft or damage caused by events occurring after supply.
Replacement of a subsequently lost or stolen key is a new service and will be charged accordingly.
12. WARRANTY ASSESSMENT
If you believe a product or service supplied by Origin Car Key Specialists is faulty, please contact us as soon as reasonably possible.
We may request:
- proof of purchase; - photographs or video of the product; - details of how and when the problem occurred; - the affected key, remote or component for inspection; and/or - access to the vehicle where diagnosis is reasonably necessary.
We must be given a reasonable opportunity to inspect and assess the alleged fault before determining the appropriate remedy.
Where reasonably necessary, testing or diagnosis may be required to determine whether the issue relates to our product or service, normal wear, a consumable component, misuse, accidental damage or an unrelated vehicle fault.
13. NO FAULT FOUND OR UNRELATED FAULTS
If inspection or diagnosis determines that the goods or services supplied by us are functioning correctly and the reported problem is caused by the vehicle, misuse, accidental damage, normal wear, a depleted consumable item, a customer-supplied component or another unrelated cause, the matter will not be treated as a defect in our goods or services.
Where permitted by law and advised to the customer where applicable, additional attendance, diagnostic work, replacement parts or further services may be chargeable.
14. REFUNDS, REPAIRS AND REPLACEMENTS
Where a product or service supplied by us fails to meet an applicable consumer guarantee, the remedy available will depend on the nature and severity of the failure and the requirements of the Australian Consumer Law.
Depending on the circumstances, this may include repair, replacement, re-supply of the service, refund or another remedy required by law.
We do not provide refunds merely because a product has been damaged through misuse, accidental damage, abnormal use, normal wear and tear or an unrelated vehicle fault.
15. UNAUTHORISED REPAIRS OR MODIFICATIONS
If a key, remote or other product has been opened, altered, modified, repaired or tampered with by the customer or another third party, this may affect our ability to determine the original cause of a reported fault.
We are not responsible for defects or damage caused by unauthorised modification, repair or interference.
However, modification or third-party work does not automatically remove any rights that the customer may otherwise have under the Australian Consumer Law for an unrelated defect.
16. PROOF OF PURCHASE
We may require reasonable proof that the goods or services were purchased from Origin Car Key Specialists before processing a warranty, refund, repair or replacement request.
Acceptable proof may include an invoice, receipt, payment record or other reasonable evidence of purchase.
17. LIMITATION OF THIS POLICY
Nothing in this policy excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law or any other applicable law where it would be unlawful to do so.
Where this policy is inconsistent with a right that cannot legally be excluded, the applicable law will prevail.
